[COVID-19] Information regarding your rights and obligations, in Vietnam

Facing the difficulties and threat of the COVID-19, Fidal Asiattorneys has informed us about our rights and obligations, in Vietnam, with regards to the COVID-19 situation as follows:

Vietnamese provisions regarding Intercom Guidelines for monitoring, prevention and control of COVID-19 of the Ministry of Health.

 

1. Medical isolation

According to Article 2 of Law on Prevention and Control of Infectious Diseases 2007, Medical isolation means the isolation of a person suffering from an infectious disease, a person suspected of suffering from an infectious disease or a pathogen carrier or articles possibly carrying agents of infectious disease in order to limit the spread of disease

According to Decision No. 963/QD- BYT dated 18/03/2020 of the Ministry of Health regarding Interim Guidelines for monitoring, prevention and control of COVID-19, COVID-19 (previously known as 2019-nCoV) is a Group A acute contagious disease.

 Pursuant Article 49 of Law on Prevention and Control of Infectious Diseases 2007 regarding organization of medical isolation:

  1. Isolation is obligatory for persons suffering from an epidemic disease, persons suspected of suffering from an epidemic disease, persons carrying epidemic pathogens, persons who have been in contact with pathogens of an epidemic disease of class A and a number of diseases of class B stipulated by the Minister of Health.
  2. Forms of isolation include home-based isolation and isolation at medical examination and treatment establishments or other establishments and places.
  3. Health establishments located in epidemic zones shall organize isolation according to instructions of heads of anti-epidemic steering committees. If those persons defined in Clause 1 of this Article fail to comply with isolation requests of health establishments, isolation measures shall be taken against them according to regulations of the Government.

Thus, according to the provisions of Vietnamese law, home-based isolation or isolation at medical examination and treatment establishments or other establishments and places for cases of suspected Corona-virus infection within 14 days is in accordance with the law.

 

2. Sampling of specimens tested for SARS-CoV-2

Decision No. 963/QD- BYT dated 18/03/2020 of the Ministry of Health regarding Interim Guidelines for monitoring, prevention and control of COVID-19, provided as follows:

For Persons in close contact with a confirmed case case (round 1 contact):

  • Investigate, review, make a list of all people in close contact with the identified case to record information about home address, place of residence, personal phone number; Names and phone numbers of family members when the need arises. Specific isolation organization is as follows:
  • Isolate at health facilities 14 days from the date of the last contact with the identified cases. In cases where medical facilities do not have adequate space for isolation, priority shall be given to isolating people living in the same households and houses with cases identified at medical establishments, other close contacts shall be isolated at Centralized isolation facility reserved for close contacts.

Sampling of specimens tested for SARS-CoV-2.

  • If the test result is positive for SARS-CoV-2, it will be treated like a confirmed case.
  • If the test result is negative for SARS-CoV-2 then continue isolation, daily health monitoring (measuring body temperature, detecting symptoms) at health facilities or concentrated isolation facilities. 14 days from the date of your last exposure to the confirmed case. During the monitoring process, if symptoms of suspected disease appear, continue to sample SARS-CoV-2 samples. After 14 days from the date of the last contact with the confirmed case, if no suspected symptoms appear, the quarantine shall end.

For  Person in contact with close contact (second contact person)

  • Request home isolation and instructions on how to self-prevent and monitor health while waiting for test results of first-person contacts:
  • If the test result of the first-round contact is positive for SARS-CoV-2, the isolation level of the second-person contact should be upgraded to the first-round contact.
  • If the test results of the first-round contacts are negative for SARS-CoV-2, the second-round contacts will be finished isolation.

Thus, according to the provisions of Vietnamese law, in order to prevent the Corona-virus epidemic, those suspected of being infected in an isolation area must take samples at the request of health workers.There is no other choice.

 

3. If the test result is positive for SARS-CoV-2, it will be treated like a confirmed case:

  • Strict isolation and treatment at medical facilities, minimize complications and deaths.
  • Limit patient referrals to avoid spreading unless beyond the ability to treat.
  • Treatment according to the guidance of the Ministry of Health.
  • Time of isolation until patients are recovered from the hospital.

In this case, the infected person cannot choose the treatment facility but must follow the recommendations and decisions of the health authorities.

Hereafter is the list of approved hospital by the HCMc’s Department of Health. Based on this list, you can choose the hospital of your choice to run Civd-19 test.
